Terms of Service

Last updated: September 25, 2026. These Terms of Service govern access to and use of digital portals, institutional custody desks, and private banking services provided by Swthe Banks and its operating network.

1. Acceptance of Terms & Scope of Service

By accessing or utilizing the online banking interfaces, API endpoints, or financial services provided by Swthe Banks—including its specialized banking divisions: Bank Svwþqh, Bank Filænks, Bank Flæmës, and Bank Ragœnks—you agree to be bound strictly by these Terms of Service.

These terms apply to all corporate account holders, family offices, institutional syndicates, and authorized delegates accessing our multi-jurisdictional financial architecture.

2. Institutional Onboarding & Compliance Verification

Account opening and access to custody desks are subject to statutory verification under Swiss FINMA directives, European Anti-Money Laundering (AML) laws, and International Know Your Customer (KYC) standards.

  • Users agree to provide accurate, up-to-date identification, legal entity registration, and ultimate beneficial ownership (UBO) records.
  • Swthe Banks reserves the right to suspend or reject transactions that fail automated or manual compliance risk thresholds.

3. Custody, Trading Execution & Settlement

All market orders, FX hedging requests, and custody transfers executed through our trading desks are subject to clearing node rules and market availability:

Execution & Slippage

Orders placed outside standard market hours or during extreme volatility will settle at the best available institutional rate upon market opening.

Custodial Segregation

Client assets and physical holdings are kept strictly off-balance-sheet and fully segregated under applicable Swiss banking law.

4. Intellectual Property & Authorized Portal Access

All content, logos, proprietary software, design systems, and financial interface algorithms across Swthe Banks digital platforms are the exclusive property of Swthe Banks and its operating subsidiaries. Unauthorized scraping, automated data harvesting, or reverse-engineering of online portals is strictly prohibited.

5. Limitation of Liability

To the maximum extent permitted under Swiss law, Swthe Banks shall not be held liable for indirect, incidental, or consequential losses resulting from market movements, third-party telecommunications outages, force majeure events, or unauthorized account access resulting from compromised user credentials.

6. Governing Law & Jurisdiction

These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the substantive laws of Switzerland.

Any dispute, controversy, or claim arising out of or relating to these terms shall be submitted to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.
